1. General
These General Terms and Conditions apply to all offers, orders, and agreements with Odonata, located at Klinkstraat 4, Wellen, Belgium, and relate to the sale of handmade knives and related products, as well as sharpening services through our online store and other sales channels.
2. Applicability
By placing an order or using our services, you accept these General Terms and Conditions. Deviations from these terms are only valid if confirmed in writing by Odonata.
3. Offer and Agreement
3.1 All offers from Odonata are non-binding unless otherwise specified.
3.2 An agreement is formed when Odonata confirms an order by email or when the customer has paid for the order, whichever occurs first.
3.3 Odonata reserves the right to refuse or cancel orders in cases of force majeure, incomplete data, or other legitimate reasons.
4. Prices and Payments
4.1 All listed prices are in Euros and include VAT unless otherwise stated.
4.2 Payment must be made using the available payment methods on our website.
4.3 Odonata reserves the right to change prices. Changes will only take effect after the acceptance of an order.
5. Delivery and Delivery Times
5.1 Delivery will be made to the address provided by the customer unless otherwise agreed.
5.2 Odonata will process and deliver the order as soon as possible. Delivery time estimates are indicative and are not binding.
5.3 Odonata is not responsible for delays or damage caused by the carrier or other external factors.
6. Sharpening Service
6.1 Odonata offers a sharpening service for knives and other sharpening items. Customers can send their knives to Odonata or deliver them in person for sharpening.
6.2 The customer is responsible for properly packaging the knives when sending them to Odonata.
6.3 The sharpening service is provided based on the customer's specifications, and Odonata will ensure the best possible finish but cannot guarantee that the result will always meet the customer's expectations.
6.4 Prices for the sharpening service will be communicated in advance and depend on the type of knife and the amount of work required.
7. Right of Withdrawal and Returns
7.1 You have the right to withdraw from the agreement within 14 days after receiving your order without providing a reason, provided the product is unused, undamaged, and in its original packaging.
7.2 In case of withdrawal, you bear the cost of return shipping.
7.3 The right of withdrawal does not apply to custom-made products or services that have been explicitly carried out with the customer's consent (such as sharpening services).
8. Warranty and Complaints
8.1 Odonata offers a lifetime warranty (based on a reasonable lifespan under normal use) on handmade knives against manufacturing defects, starting from the date of delivery.
8.2 Complaints regarding the delivered product must be reported to Odonata in writing within 7 days after receipt.
8.3 In case of valid complaints, Odonata will offer a replacement product or refund the purchase price, depending on the situation.
9. Liability
9.1 Odonata is only liable for direct damage resulting from intent or gross negligence by Odonata itself.
9.2 Odonata is not liable for damage caused by improper use of the products, including knives or other tools, by the customer.
9.3 Liability is limited to the amount covered by Odonata's insurance or the amount charged by Odonata for the relevant product or service.
10. Intellectual Property
10.1 All designs, images, texts, and other intellectual property rights related to Odonata's products and services are owned by Odonata or its licensors.
10.2 The customer is prohibited from reproducing, distributing, or otherwise using these materials without Odonata's permission.
11. Privacy and Data Protection
11.1 Odonata respects the privacy of its customers and processes personal data in accordance with applicable privacy and data protection laws (such as the General Data Protection Regulation (GDPR) in Belgium).
11.2 The data you provide will only be used for processing your order and related communication.
11.3 Odonata does not share personal data with third parties unless necessary for the execution of the agreement or legally required.
12. Applicable Law and Disputes
12.1 Belgian law applies to all agreements with Odonata.
12.2 In case of a dispute, the competent courts in Belgium will make a ruling.
12.3 As a consumer, you have the right to submit a dispute to the competent disputes committee, as provided for in Belgian consumer protection law.
